Abstract

The loss-of-a-chance theory has been increasingly used in Brazilian jurisprudence. The aim of the present study is to conceptualize the theory of the loss of a chance, specifically in the medical field, in order to relate it to the professional responsibility of the dentist. For that, narrative bibliographic research was carried out on the subject in question, on which topics were approached: study of the theory of the loss of a chance; medical professional responsibility; and, the dentist's responsibility, analyzing the theme of the application of the loss of a chance in their work routine. Concluding that the theory becomes a possibility of civil repair in cases of professional dental liability, provided that the necessary criteria are observed through technical analysis of a trained professional
